
Our client faced serious criminal charges under the Road Traffic Act (RTA), involving allegations of dangerous driving causing grievous hurt and injury. The primary charge, under Section 64(1) read with Section 64(2A)(a), related to dangerous driving causing grievous hurt to a pillion rider and was proceeded with by the Prosecution. A second charge, under Section 64(1) read with Section 65(1)(b), involving dangerous driving causing hurt to a motorcyclist, was taken into consideration.
At the outset, the Prosecution indicated a sentencing range of 6 to 8 months’ imprisonment, along with a 5-year driving disqualification, highlighting the seriousness of the offences and the potential consequences for the client.
Through strategic legal representation and detailed written submissions, Ray Louis successfully advanced strong mitigating arguments. These included the client’s personal circumstances, character, and the surrounding context of the incident, all carefully presented to achieve the best possible outcome. The submissions effectively demonstrated why a reduced sentence was appropriate.
As a result, the Prosecution agreed to a significantly reduced sentencing range of 5 to 11 weeks’ imprisonment. In addition, the original proceeded charge under Section 64(1) was successfully reduced to a lesser offence under Section 65(1)(b)—lowering the charge from dangerous driving to driving without reasonable consideration, which carries less severe penalties.
The Court ultimately imposed 10 weeks’ imprisonment and a 5-year driving disqualification from holding or obtaining all classes of driving licences. This outcome reflects the effectiveness of strong legal advocacy in road traffic offence cases, particularly in achieving charge reductions and sentencing mitigation under Singapore law.
