Successful Slip and Fall Personal Injury Claim in Residential Carpark

On 10 April 2023, our elderly client was involved in a slip and fall accident in a residential carpark while alighting from a vehicle driven by a family member. The vehicle had been parked in a designated lot on Level 1 of the carpark.

As our client stepped out of the vehicle, she unknowingly stepped on multiple small glass shards scattered on the ground. The hazardous debris caused her to lose her footing and slip. Due to the design of the carpark, a drainage trench was located directly behind the parking space, and our client fell backwards into the trench.

Following the fall, she was taken to the hospital for medical assessment and treatment. Medical examinations confirmed that she had suffered head injuries and other related injuries as a result of the accident.

After being instructed to act on our client’s behalf, Ray Louis conducted a detailed investigation into the circumstances surrounding the accident. This included examining the condition of the carpark, identifying the parties responsible for maintenance, and reviewing the relevant medical records. He also engaged with the Town Council and the independent cleaning contractor responsible for maintaining the premises.

Ray Louis subsequently pursued a personal injury compensation claim, presenting evidence that the accident resulted from the failure to properly clear hazardous glass debris from the carpark area. He set out the legal basis for liability arising from the inadequate maintenance and unsafe condition of the premises.

Over the course of more than two years, Ray Louis engaged in negotiations with the cleaning company and its representatives in an effort to resolve the matter without commencing court proceedings.

As a result of these efforts, the case was successfully resolved, with the cleaning company agreeing to compensate our client in the sum of S$12,731.28 for her injuries and losses.
