Reduced Sentence for Sexual Communication Charges Under Section 376EB of the Penal Code
Our client faced two charges under section 376EB(1), punishable under section 376EB(3)(a) of the Penal Code 1871, for making sexual communications via WhatsApp to two young male victims.
Acting as defence counsel, we prepared and advanced comprehensive written mitigation, carefully addressing the client’s personal circumstances, background, and the broader factual context of the offences. These submissions were supported by focused oral mitigation at the sentencing hearing.
Despite the Prosecution seeking a custodial sentence of three to four months’ imprisonment, the Court ultimately imposed a reduced sentence of 10 weeks’ imprisonment, reflecting the Court’s consideration of the mitigation and the applicable sentencing principles.
Client’s Review
Following the conclusion of the matter, the client shared a review on Singapore Legal Avice, thanking us for the work and support.
Legal Explainer: Section 376EB of the Penal Code (Sexual Communication with a Minor)
Section 376EB of the Penal Code 1871 criminalises the act of communicating with a minor for a sexual purpose. This offence may be committed through electronic or online means, including messaging applications such as WhatsApp, social media platforms, or other digital communication platforms.
Under section 376EB(1), an offence may be made out even where there is no physical contact. The provision is intended to address online sexual exploitation and grooming-related behaviour, and liability may arise based solely on the content and nature of the communications.
Where a person is convicted under section 376EB(3)(a), the Court has the discretion to impose a custodial sentence, depending on the facts of the case.
Sentencing Considerations for Section 376EB Offences
In determining the appropriate sentence for offences under section 376EB, the Court will typically consider factors such as:
-
The age of the victim
-
The nature and sexual explicitness of the communications
-
Whether the conduct was isolated or sustained
-
The duration and frequency of the offending behaviour
-
The offender’s personal circumstances and antecedents
-
Evidence of remorse, insight, and rehabilitative prospects
-
The need for deterrence, balanced against proportionality
Each case is assessed on its own facts, and sentencing outcomes will vary depending on the specific circumstances and the quality of mitigation presented to the Court.
Importance of Early Legal Advice
Allegations involving sexual communication offences are serious and may carry significant legal consequences, including imprisonment. Persons who are under investigation or charged under section 376EB of the Penal Code should seek early legal advice to understand their rights, options, and the applicable sentencing framework.
Timely legal representation and carefully prepared mitigation can be critical in ensuring that the Court is presented with a complete and balanced picture of the case.
